Previously, Ken and his crew began the preliminary work to convert their barn into a home for their family.

Naturally, the barn’s concrete slab/foundation was where they started, so damaged sections of the foundation were painstakingly removed and replaced. 

Next, Ken had his team remove all of the damaged sections of wood that had been rotted by exposure to water from the leaking pipes (you may remember how Jerry fell through the soft, decayed wood on one side of the barn).

Framing was completed on the first floor, which included a steel girder for the load-bearing portion of the home for the second floor, supported by concrete walls. Next, they installed the necessary plumbing and new electrical wiring before finally installing drywall.

A gourmet kitchen was pieced together, along with a large island that was an absolute must for Connie.

Drywall Mud was applied to the newly placed drywall and to other damaged portions of the original walls. It was then smoothed out and sanded. Various lighting fixtures were installed and walls were painted.

Last but not least, the flooring was laid down, including installation of tile in the three bathrooms, vinyl laminate that mimics hardwood flooring in the kitchen, and carpet in the living room, dining room, and four bedrooms.

Ken and his team, along with Jerry, wrapped up the projects about 4 weeks over schedule because of inclement weather and illness. The flu bug was passed around to the entire team, especially in the beginning. Unfortunately, their foundation contractor, Frankie, was hospitalized and unable to return to work on the project. Ken improvised on the foundation work, which delayed things a bit.

In our previous article following a couple’s journey as they attempt to convert their old barn into a new home for themselves, we witnessed the arrival of Jerry’s friend Ken, a part-time contractor who the couple are considering hiring for the project because of the significant discount he will provide them.

After an initial poor impression, Connie was surprised to see that Ken is not at all what she expected.

Here’s a recap of what happened in our previous article:

The day arrives, and Ken shows up to take some measurements and get a feel for the scope of the project.

He pulls up in a big, rusted-out pickup truck that’s caked in mud from tires to rooftop. The muffler kicks and sputters noisily while the truck idles for a moment before the driver finally kills the engine.

Jerry jogs around to the other side of the truck to greet Ken as he exits the vehicle, but Connie stays where she is.

Needless to say, so far, she is not impressed.

In our last entry into our ongoing claims scenario, farm owners Connie and Jerry asked their relative, Uncle Frank, to perform an inspection of one of their barns which they want to convert into a home, drawing inspiration from various home improvement shows.

After his careful inspection, Uncle Frank informed the couple that there is indeed some damage. Water has seeped into the concrete over time. During freezing temperatures, the water inside the pores, cracks, and crevices freezes and expands, causing damage.

What does Uncle Frank’s diagnosis mean for Connie and Jerry? Let’s find out.

“What do you think we should do, Uncle Frank?” asks Connie, concerned.

In part 1, we introduced you to Connie, a farm owner and mother who for years has wanted to move her family into a new home because her current home is a bit outdated.

She also wants a build on a different location so that her home is more conveniently located near the fields and other outbuildings on her farm.

Connie is also super frugal.  She is reluctant to pay top dollar for contractors that are so busy they are charging outrageous pricing for new home construction.

After seeing a magazine photo of a “barndominium” (a barn-turned-home), she resolved to convert one of her larger barns – one that is in just the right place on her property – into a new home for herself and her family.

Connie’s husband, Jerry, is skilled as a handyman contractor. Before getting married Jerry worked for 5 years in construction and is quite handy around the farm.

Jerry convinces Connie that he can remodel their barn into a beautiful home for much less than it would typically cost if they hired a construction company.

Jerry begins the project by doing an informal inspection, taking measurements and trying to get an idea on how to best design the layout of the barn for the conversion. He moves some plywood out of the way that was stacked up against the southeast corner of the barn.

After moving the plywood, Jerry notices water damage permeating a good portion of the wall that was hidden.

He takes a screwdriver out of his leather carpenter’s pouch and gently pokes the wall with it. It promptly goes right through the wall up to the hilt causing Jerry to lose his balance. He instinctively uses his hands to try to catch himself as he stumbles forward and ends up going partially through the wall with his hands, head, and shoulders!

Jerry is momentarily stunned. He gently moves back to prevent further damage.

He shakes himself off and says “Uh Oh. We have a problem.”  He gets his cell phone out to call Connie and tells her to get out to the barn immediately.

After further investigation they find that water has apparently been leaking for some time via the plumbing and there is a chance the foundation has been damaged because of the water leak.

In our last entry, the plaintiffs’ legal team presented evidence to the jury that does not look good for Farmer Shuck.

The evidence consisted of photographs taken of Farmer Shuck and his farm during an interview conducted as part of an agricultural study performed by a Dallas firm several months ago.

In the background of the photos, the lawyers pointed out, there can be seen a segment of fence that is damaged to the point that it would not be difficult to imagine cows being able to roam outside of the fence boundary, just as Bessie the cow had done.

Farmer Shuck had claimed early on in the trial that he always repaired his fence in a timely and responsible manner, but because he was not able to produce any receipts or records to suggest that this was the case, the lawyers were able to frame the photos as evidence that he was not as responsible about repairing his property as he claimed.

Due to the angle and framing of the photographs, it is impossible to know whether the damaged section of the fence depicted in the photo is the same section that Bessie the cow escaped through. If it is the same section of fence, the lawyers argue, then it’s clear that the fence remained unfixed for several months at least.

The jury seems to agree.

We ended last week’s article with a new question: What if these events had led to a different outcome?

Let’s wind the clock back to just before the start of the trial.

Let’s also imagine that the plaintiffs were able to produce some additional evidence to strengthen their case.

The legal team working on behalf of the Wadsworth family finds some records online of a news report from several months ago. The local news excerpt reported that a firm based in Dallas profiled several local farmers for a study being performed on the agricultural community in the area.

It just so happens that Farmer Shuck was one of the farmers who was profiled.

The legal team contacts the Dallas firm and is able to procure some photos taken of Farmer Shuck and his property during the study.

In part 4 of our fictitious insurance scenario about a car accident that occurred as a result of an escaped cow wondering off into the middle of a road, we began to answer the first of two questions raised by the lawsuit that was served to Farmer Shuck by the Wadsworth family. 

To refresh your memory, here are those two questions once more: 

  1. Is Farmer Shuck to blame for the car accident?
  2. If so, will his farm insurance cover the costs of the lawsuit?  

This week we will continue to address the first question: Is Farmer Shuck to blame? 

In our last entry, we established that, because Bessie the cow was standing on a country road rather than a federal or state highway, the county’s stock law would apply to this situation. 

A stock law is a legal limitation on the ability of farmers to allow their livestock to freely roam. It is expected that farmers must keep their farm animals confined. 

We also established that the county does, in fact, have a stock law on the books. 

Put simply, the Wadsworths must demonstrate that Farmer Shuck was negligent in regards to the keeping of his farm animals. 

How might the court determine whether he behaved with negligence? 

The plaintiffs would have to prove that Farmer Shuck knowingly allowed his cow to freely roam, a distinction that is based on such things as: 

  • Evidence of open gates, broken fencing, or a disregard for keeping a closed range;
  • Evidence of previous livestock escapes and any actions Farmer Shuck took to improve the situation;
  • Low quality fencing that is not fit for normal livestock purposes.

So, did the plaintiffs find evidence of these things after investigating Farmer Shuck? We will look at that in our next entry.
